Rule 2 (1) (i) of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 defines “Personal information” as any information that relates to a natural person which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person and Rule 3 defines “Sensitive Personal Data or Information of a Person” as such personal information which consists of information relating to (i) password; (ii) financial information such as Bank account or credit card or debit card or other payment instrument details; (iii) physical, physiological and mental health condition; (iv) sexual orientation; (v) medical records and history; (vi) Biometric information; (vii) any detail relating to the above clauses as provided to body corporate for providing service; and (viii) any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise but does not include any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force. Please read below to understand our methodology and practice for collection and distribution of personal information:

1. Personal Information
In order to access and utilize www.creativeflu.com’s (“CreativeFlu/Website”) products and services, CreativeFlu requires each customer to provide their personal information, which we collect and store, from time to time. We collect only such personal information from you that we consider necessary for giving you a safe and customized experience, which is the primary objective of this Website.

CreativeFlu also provides you the option to browse the Website without providing your personal information. However, given the nature and the function of the Website, you may be required to provide your personal information in order to avail services of the Website, in which case you are not anonymous anymore. Where possible, we try to indicate the mandatory and optional fields required. You always have the option to not provide information by choosing not to use a particular service or feature on the Website. Primarily, we use your information to identify you as a user of the Website and for maintaining and building the database of users and communicating to them news and information, however, we may also use this information to do internal research on your interests and behaviour to better understand, protect and serve your needs.

If you need to update your personal information in our records (e.g. if you change your address), please provide the updated details at the relevant place to enable us to keep updated records. However, before you are able to update/change your personal information, you may be requested to provide some verification. We shall not be responsible for the authenticity of any personal information supplied to us by you.

5. For filing complaints
If you have any queries or concerns regarding:
a) discrepancies between the personal information provided by you and the information reflected in our records and the same have not been corrected and/or updated after you have provided updated information along with any verification required; or

CreativeFlu may use cookies or web beacons to store personal information, only for the purpose of updating user preferences and to ensure fast loading of pages. Also hit counters and metres maybe used for statistical information and web reports.

Being a valued customer to us, we ensure the protection of your personal information. To prevent unauthorized access, we have implemented physical, electronic, and managerial procedures to safeguard and secure the information we collect. Though our Website has stringent security measures in place to protect the loss, misuse, and alteration of the information under our control yet we cannot guarantee its security. Whenever you change or access your account information, we offer the use of a secure server. Documents are delivered to you either via priority mail or via e-mail.

For postings using the Comments feature, your name and email will only be posted if you provide it in the comment. We strongly discourage posting any information on these features or in any Content posted by you that you do not want others to see. You agree that you are responsible for maintaining the confidentiality of your username and password, and all uses of your account, whether or not you have authorized such use.

Additionally, we strive to protect ourselves and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:

Use of foul language and transmission thereof through CreativeFlu is strictly prohibited. Unauthorized usage of login and password for access and use of CreativeFlu would attract necessary action or liability under the applicable Indian laws. Any content that is obscene, unlawful, defamatory, libellous or hateful, or has spam, commercial or advertising content or links will be removed/deleted from the Website.

9. Communication and/or transaction through the Website
All communications on and transactions emerging from CreativeFlu is strictly between the parties between whom such communication and/or transaction has taken place. CreativeFlu, its agencies and technology partners assume no liability or responsibility of any nature whatsoever as regards the accuracy, reliability, completeness, currentness, timeliness or otherwise of any of the communication and/or transaction taken as a result of accessing the Website. CreativeFlu, its agencies and technology partners also assume no responsibility as regards the quality, standard, authenticity, suitability, durability, etc. or otherwise of the content posted by its visitors/members on the Website. CreativeFlu shall not be, in any way, responsible or liable for breach of any terms as may be agreed upon by and between parties.

10. Disclosure
As per the policy, we reserve the right to display your name and such other information/basic details as may be required to identify you as a member of our Website. If you choose to post messages on our Discussion Forum, or update your member profile, we will collect the information provided to us. We retain this information as necessary to provide customer support and troubleshoot problems as permitted by law.

11. Links to Third-Party Sites
Our Websites include links to other websites, whose privacy practices may be different from those of CreativeFlu’s. If you submit Personal Information to any of those sites, your information is governed by their privacy policies.
